Terms of Use

Welcome to KasparChess. By using our app or website, you agree to these Terms of Use ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using KasparChess (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be at least 18 years old to create an account and manage a subscription. Users under 18 may use the app with permission and supervision from a parent or legal guardian who holds the account.

2. Description of Service

KasparChess is an AI-powered chess coaching tool designed for parents. The Service analyzes publicly available chess game data from Chess.com and Lichess.org to generate coaching reports, scouting reports, and personalized advice for your child's chess development.

3. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information when creating your account. KasparChess reserves the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and Payments

Free Trial: New users receive a 2-week free trial. No payment information is required during the trial.

Paid Plans: KasparChess offers monthly subscription plans (Easy and Open). Pricing is displayed in the app and may vary by platform.

Apple App Store: If you subscribe through the iOS app, payment is processed by Apple. Your Apple ID account will be charged at confirmation of purchase. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in your Apple ID Account Settings.

Google Play: If you subscribe through the Android app, payment is processed by Google Play. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions in Google Play Settings.

Web (Stripe): If you subscribe through the website, payment is processed by Stripe. You can manage and cancel your subscription from the Settings page in the app.

Refunds: Refund policies are governed by the platform through which you subscribed (Apple App Store, Google Play, or Stripe).

KasparChess is primarily designed for parents to support their children's chess development. Only users aged 18 and over may create accounts and manage subscriptions. By adding a child profile, you represent that you are the parent or legal guardian of that child and consent to the collection of their first name, birth month/year, and chess platform username for the purpose of generating coaching reports.

7. Chess Platform Data

KasparChess accesses only publicly available game data from Chess.com and Lichess.org through their public APIs. We are not affiliated with, endorsed by, or partnered with Chess.com or Lichess.org. The accuracy of coaching advice depends on the data available from these platforms.

8. AI-Generated Content

Coaching reports, scouting reports, and chat responses are generated by artificial intelligence (Anthropic Claude). While we strive for accuracy, AI-generated content may contain errors or inaccuracies. KasparChess coaching is meant to supplement, not replace, professional chess instruction. We make no guarantees about improvements in chess performance.

9. Intellectual Property

The Service, including its design, text, graphics, and software, is owned by KasparChess and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our written permission.

Coaching reports generated for you are for your personal, non-commercial use. You may share individual reports with family members, coaches, or your child's chess club.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We do not guarantee any specific chess improvement or results.

11. Limitation of Liability

To the maximum extent permitted by law, KasparChess shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid to us in the 12 months preceding the claim.

12. Account Deletion

You may delete your account at any time from the Settings screen in the app. Account deletion permanently and irreversibly removes all your data, including child profiles, coaching reports, chat history, and subscription records.

13. Changes to Terms

We may update these Terms from time to time. We will notify registered users by email of any material changes. Continued use of the Service after changes constitutes acceptance of the updated Terms.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes shall be resolved in the courts of Australia.
